Drink driving in NSW is charged according to a prescribed concentration of alcohol, or PCA, measured through a breath or blood test. The reading determines which category you're charged under, and the category determines almost everything else: the size of the fine, the length of any disqualification, whether a lawyer can realistically argue for a Section 10, and whether imprisonment becomes a genuine possibility rather than a remote one.

What this looks like day to day

Most people come to us somewhere in the first few days after a charge, still working out what actually happened. You were pulled over, or involved in a random breath test, or stopped at a booze bus. A reading came back over the limit. You may have received an immediate roadside suspension notice on the spot, meaning you're already unable to drive before you've even seen a courtroom. A charge sheet or court attendance notice follows, usually with a court date somewhere between Verify weeks out.

That gap between the charge and the court date is where the real work happens, and where the outcome is usually decided. It's the window to get legal advice, understand which PCA category applies to you, gather character references if they're relevant, and, where appropriate, look at options like the alcohol interlock program. How the PCA ranges work

Novice range applies to L and P plate drivers, who are required to have zero alcohol in their system. Any reading above 0.00 triggers a charge.
Special range applies to certain licence and vehicle categories with a lower limit than the standard 0.05.
Low range covers readings from Verify and is the most common drink driving charge NSW courts deal with.
Middle range covers Verify, carries a mandatory minimum disqualification, and removes the option of a Section 10.
High range applies to readings of Verify and above, and carries the most serious penalties short of a driving offence causing injury or death.
Refuse or fail breath analysis is treated as seriously as a high range charge, even if you were never confirmed to be over the limit.

Each range carries its own penalty structure, and the gap between them matters more than the numbers suggest. Moving from low range to middle range, for instance, removes an entire category of outcome: the Section 10 that could otherwise mean no conviction, no fine, and no disqualification at all.
